These Terms of Service (“Terms”) govern your access to the website lowcountryvitality.com (the “Site”) and your use of services provided by Lowcountry Vitality (“we,” “us,” or “our”). By using the Site or booking our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Our services

We provide mobile intravenous (IV) hydration and related wellness services, delivered by licensed registered nurses to locations within the greater Charleston, South Carolina metro area, generally Thursday through Sunday, 8 AM to 8 PM. Service availability, response times, drip menu, pricing, and service area may change without notice. A request submitted through the Site is a request, not a confirmed appointment, until we confirm it with you.

2. Not for emergencies; medical disclaimer

Our services are elective wellness services and are not emergency medical care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Information on the Site is for general informational purposes and is not medical advice, diagnosis, or treatment, and does not replace care from your personal physician. Statements regarding our services have not been evaluated by the U.S. Food and Drug Administration, and our services are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary and are not guaranteed.

3. Telehealth intake and clinician evaluation

South Carolina law requires evaluation and an order by an authorized clinician before IV therapy may be administered. Before any IV is started, our founding Physician Assistant (practicing under a physician supervision/practice agreement) performs a good-faith examination and reviews your intake. We may decline or discontinue service if, in our clinical judgment, treatment is not appropriate or safe for you.

4. Eligibility and screening

You must be 18 or older and able to provide informed consent. You agree to provide accurate health information during intake and to disclose conditions, medications, allergies, and pregnancy status. We reserve the right to refuse or stop service for any lawful reason, including safety, suspected intoxication, or contraindications.

Prices are listed on the Site and may change. We are a cash-pay concierge service and do not bill insurance. We accept major credit cards and mobile payments. HSA/FSA cards may be accepted for medically indicated services; eligibility is your responsibility. You are responsible for all applicable taxes, travel fees, and gratuities disclosed at booking.

7. Assumption of risk and informed consent

IV therapy carries inherent risks, including but not limited to discomfort, bruising, infection, vein irritation, and, rarely, allergic or adverse reactions. By receiving services, you acknowledge these risks and provide informed consent, which will also be documented at the point of care. You agree to follow aftercare instructions and to contact us or seek medical care if you experience concerning symptoms.

9. Disclaimers of warranties

The Site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Lowcountry Vitality and its owners, clinicians, contractors, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Site or services. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for professional negligence to the extent provided by law.

11. Indemnification

You agree to indemnify and hold harmless Lowcountry Vitality from claims, damages, and expenses arising out of your breach of these Terms, your misuse of the Site, or your provision of inaccurate health information.

12. Intellectual property

The Site and its content, branding, and logos are owned by Lowcountry Vitality and protected by law. You may not copy, reproduce, or use them without our written permission.

13. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Charleston County, South Carolina, unless otherwise required by law.
